Welcome to LocalMarket (“we”, “our”, “us”). By accessing or using localmarket.co.ke, our mobile applications, or any related services (the “Platform”), you agree to be bound by the following Terms & Conditions. If you do not agree, please stop using the Platform.

These Terms apply to Customers, Vendors, Delivery Partners, and Visitors.

1. Definitions

  • Customer – Any user who orders products or services through the Platform.

  • Vendor / Store – Any registered merchant selling goods via the Platform.

  • Delivery Partner – An individual or company delivering orders placed on the Platform.

  • Platform – The LocalMarket website, mobile apps, and backend systems.

  • Order – A confirmed purchase made by a customer.

2. Eligibility

To use LocalMarket, you must:

  • Be at least 18 years old,

  • Have legal capacity to enter into a contract,

  • Provide accurate registration details,

  • Use the Platform in compliance with Kenyan laws.

3. Account Registration

When creating an account, you agree to:

  • Provide truthful and updated information,

  • Maintain confidentiality of your login details,

  • Be responsible for all activities under your account.

LocalMarket reserves the right to suspend or terminate accounts for suspicious or unlawful activity.

4. Nature of Our Service

LocalMarket is a multi-vendor marketplace. We:

  • Provide an online platform for vendors to list and sell products,

  • Facilitate order processing and delivery,

  • Act as an intermediary between Customers, Vendors, and Delivery Partners.

We do not manufacture, own, or produce the goods sold on the platform.

5. Vendor Responsibilities

Vendors agree to:

  • List accurate product descriptions, pricing, and stock availability,

  • Ensure products comply with health, safety, and consumer laws,

  • Handle packaging appropriately,

  • Fulfill orders promptly.

LocalMarket may delist vendors who breach selling policies or customer safety standards.

6. Customer Responsibilities

Customers agree to:

  • Provide accurate delivery details,

  • Ensure availability to receive orders,

  • Inspect delivered items promptly,

  • Not misuse the app (fraud, chargeback abuse, fake orders, etc.).

7. Order Placement & Acceptance

  • All orders placed on the Platform are requests until accepted by the vendor.

  • Vendors may reject orders due to stock issues, distance, or operational reasons.

  • Customers will receive confirmation once the order is accepted.

8. Pricing & Payment

  • All prices are displayed in Kenyan Shillings (KES).

  • Payments can be made via M-Pesa, card, wallet, or any supported method.

  • LocalMarket may modify platform fees and delivery charges anytime.

9. Delivery Policy

  • Delivery timeframes are estimates and may vary due to vendor preparation, weather, or traffic.

  • Delivery Partners are independent contractors.

  • Customers must ensure someone is available to receive the order.

  • If delivery fails due to customer unavailability or wrong address, re-delivery charges may apply.

10. Product Conditions & Quality

  • Vendors are responsible for product quality.

  • For food, pharmacy, and perishables, customers are advised to inspect upon delivery.

  • If the product is spoiled, damaged, incorrect, or unsafe, customers must report within 1–3 hours of delivery.

11. Cancellations

  • Customers may cancel before the vendor accepts the order.

  • Once accepted, cancellation depends on the vendor policy.

  • For prepared food or customized items, cancellations may not be allowed.

  • LocalMarket reserves the right to cancel orders due to fraud or operational issues.

12. Refunds

Refunds may be issued when:

  • An order is cancelled before acceptance,

  • Vendors fail to fulfill an order,

  • Delivered items are missing, damaged, or incorrect,

  • Delivery is extremely delayed due to vendor negligence.

Refund processing time: 1–7 business days, depending on payment provider.

Refunds may be issued as:

  • M-Pesa reversal,

  • Card refund,

  • Wallet credit.

13. Prohibited Activities

Users may not:

  • Use the platform for illegal activities,

  • Interfere with operations (hacking, automated scripts, spam),

  • Misrepresent identity,

  • Abuse promotions or referral systems,

  • Sell or distribute restricted items (drugs, weapons, counterfeit goods).

14. Intellectual Property

All platform content — logo, design, graphics, software, and branding — belong to LocalMarket or its licensors.
Users may not copy, modify, or redistribute platform content without permission.

15. Third-Party Links

The Platform may contain links to third-party services.
LocalMarket is not responsible for their content, practices, or operations.

16. Limitation of Liability

To the maximum extent permitted by Kenyan law:

  • LocalMarket is not liable for vendor actions, product defects, delivery partner conduct, or losses arising from use of the Platform.

  • LocalMarket does not guarantee uninterrupted service.

  • LocalMarket will not be liable for indirect, incidental, or consequential damages.

17. Indemnity

By using the Platform, you agree to indemnify and hold LocalMarket harmless from any claims or damages arising from:

  • Violation of these Terms,

  • Misuse of the Platform,

  • Breach of rights of others.

18. Account Suspension & Termination

LocalMarket may suspend or terminate accounts for:

  • Fraudulent or suspicious activity,

  • Abuse of services,

  • Violation of marketplace rules,

  • Legal or regulatory requirements.

19. Changes to Terms

We may update these Terms occasionally.
Changes will be posted on the Platform with the updated date.
Continued use of LocalMarket constitutes acceptance of updated Terms.

20. Governing Law

These Terms are governed by the laws of the Republic of Kenya.
